The Director of the Department of Health and Senior Services, finding it necessary to protect public health and prevent the further spread of COVID-19, pursuant to the authority granted under section 192.020, RSMo, and 19 CSR 20-20.040, hereby orders the following:

Missouri COVID-19 Vaccination Sweepstakes
MO VIP

The Department of Health and Senior Services will conduct the MO VIP Sweepstakes Promotion according to the following Terms and Conditions:

  1. Definitions
    1. “529 MOST Plan Prize” means a prize of ten thousand dollars ($10,000.00) deposited into a type of investment account that can be used for education savings. Confirmed Minor Winners will be named as a beneficiary of a 529 MOST Plan that will be owned by and managed by the Department until they are eighteen (18) years old.
    2. “Adult Claiming Form” means the form that is a part of the Adult Prize Claim Packet that a Preliminary Adult Winner must complete and return to the Department prior to becoming a Confirmed Adult Winner. This form requires a Preliminary Adult Winner to have a valid social security number.
    3. “Adult Entrant” means an Eligible Adult who has voluntarily entered the Promotion via the Promotion Webpage or the Promotion Hotline.
    4. “Adult Prize Claim Packet” means the combined documentation that a Preliminary Adult Winner needs to submit in order to confirm his or her identity and vaccination status. An Adult Claiming Form and a W-9 Form must be completed and submitted to the Department. A copy of the Eligible Adult’s Vaccination Card and Government-issued ID must also be provided.
    5. “Alternate Adult Winner” means an Eligible Adult who voluntarily entered into the Promotion and was drawn as an alternate during a drawing.
    6. “Alternate Minor Winner” means an Eligible Minor who was voluntarily entered by his or her parent or legal guardian into the Promotion and was drawn as an alternate during a drawing.
    7. “Blue Pool” means all Minor Entrants.
    8. “Cash Prize” means a ten thousand dollar ($10,000.00) prize that will be awarded to Confirmed Adult Winners. The Cash Prize is subject to debt-offsets for debts owed to the State of Missouri.
    9. “Confirmed Adult Winner” means an Eligible Adult who voluntarily entered into the Promotion and was drawn as a Preliminary Winner. A Confirmed Adult Winner’s vaccination record was able to be verified by the Department and the individual submitted the completed Adult Prize Claim Packet within the ten (10) business day response requirement. The ten (10) business day timeline begins the next business day after the Department Contacts the individual stating that they are a Preliminary Adult Winner.
    10. “Confirmed Minor Winner” means an Eligible Minor who was voluntarily entered by his or her parent or legal guardian into the Promotion and was drawn as a Preliminary Winner. A Confirmed Minor Winner’s vaccination record was able to be verified by the Department and the individual’s parent or legal guardian submitted the completed Minor Prize Claim Packet within the ten (10) business day response requirement. The ten (10) business day timeline begins the next business day after the Department Contacts the individual’s parent or legal guardian stating that the minor child is a Preliminary Minor Winner.
    11. “Contact” means the Department’s initial communication via telephone call and e-mail message to notify a Preliminary Adult Winner or the parent or legal guardian of Preliminary Minor Winner after a drawing. The latter communication starts the ten (10) business day timer for the confirmation process.
    12. “Department” means the Missouri Department of Health and Senior Services.
    13. “Domicile” means the place an individual intends to be his/her permanent home; a place that he/she intends to return whenever absent. A domicile, once established, continues until the individual moves to a new location with the true intention of making his/her permanent home there. An individual can only have one domicile at a time.
    14. “Dose” means the first administration of a COVID-19 vaccination if receiving either the Pfizer or Moderna vaccine or the one sole administration, if receiving the Johnson & Johnson vaccine.
    15. “Eligibility Disqualifier” means any of the following conditions that prohibit an Eligible Adult from winning a Cash Prize or an Eligible Minor from winning a 529 MOST Plan Prize during the Promotion:
      • Individual entered incorrect or false information in any field of any form or document at any stage of the Promotion;
      • Individual is a current employee or member of the Household of an Employee of the Missouri Lottery Commission, the Missouri Department of Health and Senior Services, the Missouri Office of the Treasurer, the Office of the Governor of Missouri, or the Missouri Office of Administration;
      • Individual is a current Governor’s appointee, who is both in a position confirmed by the Missouri Senate and currently employed by the State of Missouri, or a member of his or her Household;
      • Individual is a current member of the General Assembly or a member of his or her Household;
      • Individual is a current member of the United States Congress or a member of his or her Household;
      • Individual is a current Statewide Elected Official or a member of his or her Household; or
      • Individual is currently incarcerated on the basis of any felony conviction.
    16. “Eligible Adult” means any Missouri Resident aged eighteen (18) or older who has received a Dose and does not have an Eligibility Disqualifier.
    17. “Eligible Minor” means any child in the legal custody of a Missouri Resident, who was at least twelve (12) years of age and younger than eighteen (18) years of age at the time he or she received a Dose and does not have an Eligibility Disqualifier.
    18. “Form 1099-MISC” means the IRS tax form used to prepare and file an information return to report various types of income other than wages, salaries, and tips.
    19. “Household” means persons living in the same residence who maintain a single economic unit. Included in this definition is any person who is a member of and participates in the maintenance of the Household.
    20. “Lottery” means the Missouri Lottery Commission.
    21. “Minor Claiming Form” means the form issued by the Department that must be completed and submitted by a Preliminary Minor Winner’s parent or legal guardian along with other documentation in the Minor Prize Claim Packet in order for the Preliminary Minor Winner to become a Confirmed Minor Winner.
    22. “Minor Entrant” means an Eligible Minor who has been voluntarily entered into the Promotion by his or her parent or legal guardian via the Promotion Webpage or the Promotion Hotline. Such Minor’s eligibility will be determined based on his or her age at the time of receiving a Dose.
    23. “Minor Prize Claim Packet” means the documentation that a parent or legal guardian of the Preliminary Minor Winner needs to submit in order to confirm his or her child’s identity and vaccination status. A Minor Claiming Form must be completed and submitted to the Department and the parent or legal guardian of a Preliminary Minor Winner must also provide the Department with a copy of his or her child’s Birth Certificate and a copy of his or her child’s Vaccination Card.
    24. “OA” means the Missouri Office of Administration.
    25. “Preliminary Adult Winner” means an Eligible Adult who voluntarily entered into the Promotion and was drawn as a winner during one of the drawings.
    26. “Preliminary Minor Winner” means an Eligible Minor who was voluntarily entered into the Promotion by his or her parent or legal guardian and was drawn as a winner during a drawing.
    27. “Promotion Hotline” means the following telephone number (877) 435-8411, which may be used for registration. The accessible hours for this telephone number will typically be weekdays from 7:30 AM CDT until 7:30 PM CDT during the Promotional Period, however, the accessible hours are subject to change.
    28. “Promotion Webpage” means the Department’s registration webpage for entry into the Promotion that can be accessed at the following webpage address:
      www.mostopscovid.com/win
    29. “Promotion” means the Missouri COVID-19 Vaccination MO VIP Sweepstakes.
    30. “Promotional Period” means the time that the Department will accept entries for the Promotion beginning July 21, 2021 and ending October 6, 2021.
    31. “Red Pool” means Adult Entrants who receive a Dose on or after July 21, 2021.
    32. “Region” means one (1) of the eight (8) Missouri Congressional Districts.
    33. “Resident” means an individual who is Domiciled in Missouri, unless the individual:
      • Maintains no permanent place of abode in this state;
      • Does maintain a permanent place of abode elsewhere; and
      • Spends in the aggregate not more than thirty (30) days of the taxable year in Missouri.
      It can also mean an individual who is not Domiciled in Missouri but:
      • Did have permanent living quarters in Missouri; and
      • Spent more than one hundred eighty three (183) days of the taxable Year in Missouri.
    34. “Terms and Conditions” means this document which contains definitions of the terms and an explanation of the procedures that control the Promotion.
    35. “Vaccination Card” means the paper card titled “COVID-19 Vaccination Record Card” that an individual is given when receiving a Dose.
    36. “W-9 Form” means the form used by a third party who must file an information return with the Internal Revenue Service. It requests the name, address, and taxpayer identification information of a taxpayer.
    37. “White Pool” means Adult Entrants who received a Dose before July 21, 2021.
  2. Cash Prize Drawings Overview (Red Pool & White Pool)
    • The Department, with assistance from Lottery, will conduct a total of five (5) random number drawings from the eight (8) Regions, with the drawings occurring two (2) weeks apart during the Promotional Period for Cash Prizes for Adult Entrants. Each drawing will draw ten (10) Preliminary Adult Winners and twenty (20) Alternate Adult Winners from the Red Pool and ten (10) Preliminary Adult Winners and twenty (20) Alternate Adult Winners from the White Pool in each of eight (8) Regions. Each Preliminary Adult Winner will be verified by the Department prior to being publicly announced. Preliminary Adult Winners must complete and return an Adult Prize Claim Packet in order to win a Cash Prize.
  3. 529 MOST Plan Drawings Overview (Blue Pool)
    • The Department, with assistance from Lottery, will conduct five (5) statewide random number drawings of the Blue Pool. At each drawing, twenty (20) Preliminary Minor Winners and forty (40) Alternate Minor Winners will be drawn for a 529 MOST Plan Prize. All Preliminary Minor Winners will be verified by the Department prior to being publicly announced. Preliminary Minor Winners must have a parent or legal guardian complete and return a Minor Prize Claim Packet in order to be awarded a 529 MOST Plan Prize.
  4. Registration
    • An Eligible Adult may register for the Promotion by:
      1. Submitting required information and agreeing to specific conditions online at the Promotion Webpage (www.mostopscovid.com/win)
      2. Calling the Promotion Hotline (877) 435-8411 and verbally disclosing required information to a call center operator who will enter the information on the Eligible Adult’s behalf. The Eligible Adult must also verbally agree to specific conditions prior to his or her registration being accepted.
      An Eligible Minor may register for the Promotion by:
      1. Having a parent or legal guardian submit required information and agree to specific conditions online at the Promotion Webpage (www.mostopscovid.com/win)
      2. Having a parent or legal guardian call the Promotion Hotline (877) 435-8411 and verbally disclose required information to a call center operator who will enter the information on the Eligible Minor’s behalf. The Eligible Minor’s parent or legal guardian must also verbally agree to specific conditions prior to the Eligible Minor’s registration being accepted.
  5. Entry Periods, Deadlines, and Drawing Dates
    • Five (5) drawings will be conducted, with each drawing occurring every two weeks for each of the eight (8) Regions.
      1. Registration must be submitted online at www.mostopscovid.com/win by 11:59 PM CDT or entered by calling (877) 435-8411 by 7:29 PM CDT of the Wednesday immediately before a drawing.
      2. Information entered by the Eligible Adult or the parent or legal guardian of an Eligible Minor will determine in which drawing pool the individual is placed.
      3. Eligible Adults and the parent(s) or legal guardian(s) of Eligible Minors may only submit one (1) entry into the drawings. The Department will remove all duplicate entries. Multiple entries may disqualify an Adult Entrant or Minor Entrant from the Promotion.
      4. All Adult Entrants and Minor Entrants that are not drawn as a Preliminary Adult Winner or Preliminary Minor Winner will carry over from one drawing to the next. An Adult Entrant or Minor Entrant may not win more than one (1) drawing for the entirety of the Promotion.
      5. Drawings will be conducted with assistance and oversight by Lottery according to the schedule below.

  7. Drawing Procedures
      1. Lottery will conduct the randomized drawing, using its software, according to the number value ranges provided by the Department for each drawing category. There will be seventeen (17) total categories drawn at each drawing.
      2. The Department will use the following written protocol to prepare for the drawing after a registration period closes.
        • Remove duplicate entries.
        • Assign a unique identification number to each entry.
        • Download the list of Adult Entrants and Minor Entrants to an Excel file using a dedicated laptop.
        • Prepare the Excel file for the drawing by sorting entries into their respective categories.
        • Lock and password protect the Excel file.
        • Screen capture the Excel file metadata which clearly indicates the “Last saved by” and “Date last saved” fields as well as its status of password protection and the file name itself and e-mail the image to Lottery along with the total number of Adult Entrants for each respective Region and pool as well as the total number of Minor Entrants.
        • At least three (3) Department staff will oversee and certify that the process was followed in accordance with the written protocol by signing a written protocol certification document. Such document will be retained by the Department.
      3. The Department will use the following written protocol to conduct the drawing:
        • On the date of a drawing, Lottery will use a random number generator to draw ten (10) Preliminary Adult Winners and twenty (20) Alternate Preliminary Adult Winners for all sixteen (16) lists connected to Cash Prizes for each of the five (5) drawings.
        • Lottery will use a random number generator to draw twenty (20) Preliminary Minor Winners and forty (40) Alternate Preliminary Minor Winners for the one (1) list connected to the 529 MOST Plan Prize for each of the five (5) drawings.
        • After the numbers have been drawn, Department staff will open and unlock the password protected Excel file in the presence of Lottery Security Staff, who will verify that the Excel file metadata matches the screen capture e-mailed from the previous day.
        • All Preliminary Adult Winners, Alternate Adult Winners, Preliminary Minor Winners, and Alternate Minor Winners will be verified in the presence of at least one (1) employee of the Department, one (1) employee of Lottery, and one (1) employee of the Lottery Security team.
        • The Department will subsequently generate a document containing the Preliminary Adult Winners and Alternate Adult Winners or the Preliminary Minor Winners and Alternate Minor Winners for each drawing conducted on a drawing day. Such documents will be attached to a written protocol certification document which will certify that the process followed the written protocol. Such document will then be signed by two (2) employees of the Department, one (1) employee of Lottery, and one (1) employee of the Lottery Security team. The document will be retained by the Department.
        • After the conclusion of the drawings, the Department will complete the process of confirming Preliminary Adult Winners and Preliminary Minor Winners.
      4. The Department will publicly announce Confirmed Adult Winners and Confirmed Minor Winners.
  8. Cash Prize Confirmation Process
    1. Following the drawing at Lottery and as soon as feasibly possible, the Department will Contact all Preliminary Adult Winners using the contact information entered at registration. The e-mail will contain a link to the Adult Prize Claim Packet, which can be submitted online by a fillable form. A Preliminary Adult Winner may also print the Adult Prize Claim Packet and return it to the Department via US mail addressed to PO Box 570 – Jefferson City, MO 65102 or facsimile (fax) transmission to (573) 751-0247. In the event that a Preliminary Adult Winner opts to print the Adult Prize Claim Packet rather than submit it online, he or she shall notify the Department of this decision by an e-mail or by calling (877) 435-8411.
    2. The Preliminary Adult Winner must complete and return the required documentation to the Department within ten (10) business days of being Contacted by the Department. Receipt will be determined by either the digital timestamp of an online submission, the physical receipt of a mailed packet, or the facsimile (fax) transmission timestamp of a faxed packet.
    3. In the event that an entry is deemed invalid, an Eligibility Disqualifier is identified, the individual fails to cooperate with the Department or Lottery, or the individual fails to return an Adult Prize Claim Packet to the Department within ten (10) business days after being Contacted by the Department, an Alternate Preliminary Adult Winner will be Contacted and sent an Adult Prize Claim Packet. This process shall continue until the requisite number of Preliminary Adult Winners successfully complete and submit the Adult Prize Claim Packet within the ten (10) business day response requirement. All Alternate Preliminary Adult Winners selected will be used in the order in which they were originally drawn.
    4. Submitted Adult Prize Claim Packets received by the Department will be shared with Lottery. Lottery will process all Confirmed Adult Winners, withhold any necessary amount(s), and subsequently issue a check to each Confirmed Adult Winner. Each Confirmed Adult Winner is responsible for all taxes owed on any Cash Prize won. All state and local laws, applicable taxes, and regulations apply. Lottery will also provide OA with the necessary information to properly issue each Confirmed Adult Winner a Form 1099-MISC.
  9. 529 MOST Plan Prize Confirmation Process
    1. Following the drawing at Lottery and as soon as feasibly possible, the Department will Contact the parent or legal guardian of all Preliminary Minor Winners using the contact information entered at registration. The e-mail will contain a link to the Minor Prize Claim Packet, which can be submitted by the Preliminary Minor Winner’s parent or legal guardian online by a fillable form. The parent or legal guardian of a Preliminary Minor Winner may also print the Minor Prize Claim Packet and return it to the Department via US mail addressed to PO Box 570 – Jefferson City, MO 65102 or facsimile (fax) transmission to (573) 751-0247. In the event that the parent or legal guardian of a Preliminary Minor Winner opts to print the Minor Prize Claim Packet rather than submit it online, he or she shall notify the Department of this decision by an e-mail or by calling (877) 435-8411.
    2. The parent or legal guardian of the Preliminary Minor Winner must complete and return the required documentation to the Department within ten (10) business days of being Contacted by the Department. Receipt will be determined by either the digital timestamp of an online submission, the physical receipt of a mailed packet, or the facsimile (fax) transmission timestamp of a faxed packet.
    3. In the event that an entry is deemed invalid, an Eligibility Disqualifier is identified, the parent or legal guardian of the Preliminary Minor Winner fails to cooperate with the Department, or the parent or legal guardian of the Preliminary Minor Winner fails to return a Minor Prize Claim Packet to the Department within ten (10) business days, an Alternate Preliminary Minor Winner will be Contacted and sent a Minor Prize Claim Packet be used. This process shall continue until the requisite number of parents or legal guardians of Preliminary Minor Winners successfully complete and submit the Minor Prize Claim Packet within the ten (10) business day response requirement. All Alternate Preliminary Minor Winners selected will be used in the order in which they were originally drawn.
    4. A 529 MOST Plan will be established on behalf of each Confirmed Minor Winner, who shall be listed as the sole beneficiary.
    5. The Department shall be the exclusive owner of the 529 MOST Plan until the beneficiary reaches the age of eighteen (18), at which time the Department shall transfer ownership to the beneficiary, or guardian, if one exists.
    6. Funds of a 529 MOST Plan will not be released to the beneficiary before his or her eighteenth (18th) birthday for any reason. Further, the Department will not allow any expenses to be deducted from the account until it is transferred.
    7. If, prior to his or her eighteenth (18th) birthday, a beneficiary dies, the Department will transfer the funds of the 529 MOST Plan in accordance with the general rules of descent under Missouri law.
  10. Internet Conduct and Limitation of Liability
    • Any attempt by a user, participant or any other individual to deliberately damage the Promotion website or online entry form, or undermine the legitimate operation of this Promotion, is a violation of criminal and civil laws, and should such an attempt be made, the State of Missouri reserves the right to seek the prosecution of and/or damages from any such person or persons as permitted by law. Furthermore, such person may be excluded from the Promotion. Neither the State of Missouri, nor the Governor of the State of Missouri, any of its employees, commissioners, owners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents are responsible for late, or incomplete or misdirected entries, or responsible for incorrect or inaccurate information, whether caused by the online entry form, or by any of the equipment or programming associated with or utilized in this Promotion.

      Neither the State of Missouri, nor the Governor of the State of Missouri, any of its employees, commissioners, owners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents are responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Promotion, which may include without limitation, inaccessibility or unavailability of the internet, the Promotion Webpage or any combination thereof; theft or destruction or unauthorized access of the Promotion Webpage; any injury or damage to the participants or to any other person's computer(s) or smartphone related to or resulting from participating in this Promotion, or downloading materials from or use of the Promotion Webpage.
  11. General Provisions
    • Acceptance of a Cash Prize constitutes Confirmed Adult Winner’s permission for the State of Missouri and Lottery and their respective designees to use such individual’s name, photograph, and address (city and county) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation.

      Acceptance of a 529 MOST Plan Prize constitutes permission from the parent or legal guardian of a Confirmed Minor Winner for the State of Missouri and its respective designees to use such individual’s name and address (city and county) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation. In the event that a Confirmed Minor Winner’s parent or legal guardian submits written permission to the Department, a Confirmed Minor Winner’s photograph may be used by the State of Missouri and its respective designees may use such individual’s photograph for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without further compensation.

      Further, by accepting a Cash Prize or 529 MOST Plan Prize, each Confirmed Adult Winner or Confirmed Minor Winner agrees to hold the State of Missouri, including its Governor, any of its employees, commissioners, owners, directors, officers, affiliates, subsidiaries, contractors, assignees and agents, absolutely harmless against any and all claims and/or liability arising out of the ownership and/or use of a Cash Prize or 529 MOST Plan Prize. Each Confirmed Adult Winner or Confirmed Minor Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in the Promotion or use or redemption of any Cash Prize or 529 MOST Plan Prize. The State of Missouri makes no warranty, guarantee or representation of any kind concerning any Cash Prize or 529 MOST Plan Prize (or any portion thereof) and disclaims any implied warranty. By participating in the Promotion, all Adult Entrants and the parent(s) or legal guardian(s) of Minor Entrants agree to be bound by these Terms and Conditions. All materials submitted to the Department become the property of the State of Missouri and will not be returned. These Terms and Conditions cannot be modified or amended in any way except for a written Health Order issued by the Department. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision was not contained herein.

      No cash alternative or prize substitutions will be allowed. Confirmed Adult Winners shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable Cash Prize.

      ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION, AND ENFORCEABILITY OF THESE TERMS AND CONDITIONS OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR THE DEPARTMENT IN CONNECTION WITH THE PROMOTION SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MISSOURI WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS.

This order shall be effective on July 21, 2021 and shall remain in effect until December 31, 2021 unless rescinded prior to expiration.
